Terms of Service

1. Acceptance of Terms
By accessing or using The Knew York Times platform at kytimes.ai (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service. We may update these Terms from time to time, and your continued use of the Service after any such changes constitutes acceptance of the revised Terms.
2. Description of Service
The Knew York Times is a book ranking platform that allows authors and publishers to bid for featured placement on curated best seller lists. The Service provides:
- Curated best seller lists across multiple genres and categories.
- A bidding system through which authors and publishers can compete for ranked placement on these lists.
- Author profiles, book listings, and related promotional tools.
- Public-facing book ranking pages that display winning placements.
Placement on any list is determined by bid amount and is not an endorsement of literary quality. The Knew York Times does not represent that any ranking reflects editorial judgment or sales data.
3. Account Registration and Responsibilities
To access certain features of the Service, you must create an account. You may register using email and password, Google OAuth, or Apple Sign In. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and not share them with any third party.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at contact@kytimes.ai if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
4. Bidding and Payment Terms
The Service operates a competitive bidding system for placement on best seller lists. By placing a bid you agree to the following:
- All payments are processed securely through Stripe. We do not store your full credit card details on our servers.
- A bid is a binding commitment to pay the specified amount if your bid wins placement on a list.
- Winning bids are charged upon the close of the bidding period. Lost bids are not charged; any pre-authorized holds are released automatically.
- If a charge was captured for a bid that did not win, you are entitled to a full refund. Refunds are processed back to the original payment method via Stripe and may take 5–10 business days to appear.
- Winning bids are generally non-refundable once placement has been published, except where required by applicable law.
- All prices are displayed in US Dollars unless otherwise stated. You are responsible for any applicable taxes.
5. Intellectual Property
All content, branding, design, and software that make up the Service — including but not limited to the name “The Knew York Times,” logos, page layouts, and ranking algorithms — are the intellectual property of The Knew York Times and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.
6. User Content
You may submit content to the Service, including book listings, book descriptions, author biographies, and cover images (“User Content”). By submitting User Content you represent and warrant that:
- You own or have the necessary rights and licenses to submit and display the content.
- Your content does not infringe the intellectual property or other rights of any third party.
- Your content is accurate and not misleading.
You retain ownership of your User Content. By submitting it, you grant The Knew York Times a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service.
We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.
7. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Submit false, misleading, or fraudulent book listings or account information.
- Manipulate the bidding system through automated scripts, bots, shill bidding, or collusion with other users.
- Attempt to gain unauthorized access to other accounts, the Service's infrastructure, or related systems.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Scrape, harvest, or collect data from the Service without written permission.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Upload content that is defamatory, obscene, hateful, or otherwise objectionable.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE KNEW YORK TIMES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Termination
We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may also delete your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — will remain in effect.
11. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Effective date” at the top of this page and, where appropriate, notify you via email or an in-app notice. Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
